6. Offences against a human being
 
  Article 58-Offences relating to harassment  
58.1 Harassment  
  Harassment is the act of systematic and/or continued unwanted and annoying actions of one party or a group, including threats and demands upon a person who has formerly requested such actions cease.
 
 
 Primary Fact(s)
 1. That the victim and the accused came into contact;
 2. That the victim did not give/or withdrew their consent for the contact;
 3. That the accused ignored such non-consent of the victim and proceeded with the contact;
 
 
 Penalty Conditions (Level-3 Crime)
Type Condition(s)
1-3
a) in the application of pressure and intimidation in order to collect a bill;
b) if a neighbour locked in some dispute with the victim;
c) as an attempt to force someone to quit a job;

4-6
a) in the attempt to obtain sexual favors;
b) if out of personal malice;
 
 
 Penalty Conditions (Level-4 Crime)
Type Condition(s)
1-3
a) in motivation for racial and or religious prejudice;
b) if merely gain sadistic pleasure from making someone anxious or fearful;
4-6
a) if in direct breach of a court order to cease such harassment behaviour;
 
 
 Penalty Conditions (Level-5 Crime)
Type Condition(s)
1-3
a) if previously convicted of a charge of harassment;
4-6
a) if previously convicted of a serious criminal charge of violence against the victim and in breach of a court order to cease such behaviour;
